Clery Report: Sexual Assault

The Evergreen State College will not tolerate sexual violence, including rape, sexual harassment or sexual assault.

The Evergreen State College is committed to providing students with an environment conducive to the pursuit of knowledge. Admission to the College carries with it the presumption that students will conduct themselves as responsible members of the community and refrain from actions that would endanger the health, welfare, or safety of others.

Conduct constituting sexual violence, such as rape, sexual or physical assault, stalking or sexual harassment, will not be tolerated. Students who commit sexual offenses of any form can be prosecuted under Washington State Criminal Code (RCW Chapter 9A) and/or disciplined under the College’s Student Conduct Code (WAC174-120) specifically WAC175-120-035, clause 8, “Harm and Harassment:”

“ Harm/harassment: Discriminating against, sexually harassing, and threatening or intimidating against another person by word or gesture, or physically molesting or assaulting another person which substantially harms or causes reasonable apprehension of such harm to that person or which is intended to harm him or her. This includes, but is not limited to, physical, psychological or sexual harm/harassment or harassment based on religion, nationality, ability/disability, gender, sexual orientation, racial or ethnic origin, cultural identity or political affiliation. This provision in the codes is intended to protect members of the college community against damage or threat of damage to property and injury or threat of injury to physical person or psychological well-being.”

The College is committed to preventing all forms of sexual assault and to providing accessible, responsive services for dealing with such offenses.  Sexual violence can include any form of actual or attempted sexual activity perpetrated upon a person without that person's consent. This includes both sexual behavior coerced through physical or verbal threats, force or other forms of manipulation and sexual behavior when one person cannot give consent due to incapacitation. Such activities are against the law and are a direct violation of the College's Student Conduct Code, specifically the sections related to harassment/physical harm and/or Sexual Harassment. When violations are believed to have occurred, disciplinary action and/or criminal action can be pursued.

Sexual Assault Response Team

The Evergreen State College Sexual Assault Response Team (SART) is a multidisciplinary team designed to be activated when a report of sexual violence is made. When activated, the team is charged with defining the specific actions individual Staff are expected to take in assisting victims of sexual violence.

Services

The Evergreen State College, Office of Sexual Assault Prevention (OSAP) was created to provide culturally sensitive and appropriate services and support to survivors of sexual assault.

Some of the services OSAP can provide:

  • Information about reporting procedures and what to expect;
  • Accompaniment to the hospital, during a sexual assault exam, and/or to the police station;
  • Legal advocacy, assistance with protective orders, and court accompaniment;
  • Emergency crisis intervention, counseling and referrals;
  • Counseling for the victim’s partner, spouse or fa mily;
  • Assistance in accessing community resources;
  • Services specific to traditionally under-served groups;
  • Information about sexually transmitted diseases , HIV and pregnancy testing.
  • Medical advocacy ( the coordinator is also well-versed in the unique issues and barriers that transgender individuals might experience in medical situations related to sexual violence)

OSAP provides advocacy and support as well as education and prevention programs designed to increase student awareness about sexual assault, and reduce student risk of sexual assault, on college campuses. Educational programs are facilitated throughout the year, often collaborating with student affairs, residential life staff, health and counseling, and various student groups to offer culturally relevant programming for all students.

OSAP is committed to being a culturally competent, Queer-positive, Transgender-positive space and provides services sensitive to the unique needs of all students, staff and faculty, particularly those whom are members of groups disproportionately affected by sexual violence. OSAP collaborates with community agencies, First People's Advising and student activities groups to provide advocacy and services relevant to each individual.

Legal and Campus Reporting Options

The decision to report a sexual assault lies within the discretion of the survivor.

If a survivor wishes to access services, but is unsure of whether they would like to lodge a criminal report, they may contact the Office of Sexual Assault Prevention at 360-867-5221. O.S.A.P services are entirely confidential and O.S.A.P will not report the incident to law enforcement without the consent of the survivor.

Legal Reporting Options

If a survivor/victim would like to report a sexual assault, they may contact the campus police or sheriff’s department for the jurisdiction where the assault occurred.

    An officer taking a report will thoroughly investigate the allegations and depending on the outcome, will make an arrest and/or forward the information to the Thurston County Prosecutor. The officer will notify the Sexual Assault Prevention Coordinator as soon as possible. The coordinator will ask if you wish to have a professional advocate present during evidentiary questioning and for on-going support. If the accused is identified, a report will be filed with the Thurston County Sheriff’s office. When a campus police report is filed, the Grievance Officer is notified and will meet with you to discuss your grievance options if you wish.

    Even if you decide that you don’t want to contact the police or are unsure what you want to do, call to discuss your options.
    The coordinator will provide support and assistance you with making choices and seeking help.

Campus Reporting Options and Process

Survivors of sexual assault are strongly encouraged to use both the campus grievance process, sexual harassment complaint process, and the criminal justice system in pursuing action against the alleged assailant.

If the alleged assailant is a student, the survivor is encouraged to meet with the Campus Grievance Officer and/or Civil Rights Officer to file a written complaint. A written complaint allows the Grievance Officer and/or Civil Rights Officer to initiate an investigation. The Grievance Officer and/or Civil Rights Officer will treat such a complaint with high priority and will conduct a fair and impartial investigation. Both parties will have the opportunity to tell their side of the event.

Who to contact:

  • The Grievance Officer - Complaints regarding violation of rules of conduct by Evergreen students should be directed to the Campus Grievance Office.  The current Grievance Officer is Andrea Seabert-Olsen at 360-867-6891, seaberta@evergreen.edu .

    These complaints will be processed in accordance with the College Governance and Grievance procedures. For more complete information concerning the judicial process, rights of the student who is the subject of the complaint, rights of the student bringing forward the complaint, and possible sanctions, click here. In the case of an alleged sexual assault, the student bringing the complaint forward has the right to be notified about the outcome of the judicial hearing and any sanctions imposed. There is no established time frame for filing a complaint; however survivors are urged to file a complaint as soon as possible. Sexual Misconduct/Assault allegations are covered under Harm/Harassment in the Student Conduct Code.
  • College Civil Rights Officer - The campus Civil Rights Officer is responsible for enforcing the college's commitment to promote, maintain and encourage a learning and work environment free from all forms of discrimination, including sexual harassment.

    Sexual assault is considered a form of sexual harassment. A person who believes that they have been harassed or subject to discriminatory treatment within the Evergreen Community because of race, color, national origin, sex, age, marital status, sexual orientation, religion, disability, pregnancy or veteran status, or has been retaliated against for participating in such a complaint process, is urged to utilize the complaint procedures provided by the college through the Civil Rights Office.

The Coordinator of the Office of Sexual Violence Prevention is available at (360)867-5221 or at the office in Sem I room 4119.

If a sexual assault or rape should occur, the victim should take the following actions:

  1. Go to a safe place
  2. Call 911 or go as soon as possible to the emergency room, private doctor's office or Student Health and Counseling Center. Even if you feel your physical injuries are not serious, you may have unseen cuts and bruising that need medical attention.
  3. Tell the medical facility you were sexually assaulted and request a forensic evidence exam. If you would like to report the crime at this time, ask them to call the police.
  4. Ask the medical facility to call a support person, such as a family member, friend or sexual assault advocate.
  5. For medical and forensic evidence purposes, it is important that you not shower, wash or douche after the assault. It is also important to save your clothing and any other evidence of the assault.
  6. Continue to receive support for yourself.

Support is available to students whether or not an incident occurs on or off campus. 
Students can receive support from the Student Health Center, Student Counseling Center and the local rape advocacy organization.

Following an incident, victims are encouraged to make a report to the college or Evergreen PD.

  • This action does not obligate prosecution, but it does make legal action possible if a decision to prosecute is made at a later date. The earlier an incident is reported, the easier it is to collect valuable evidence.
  • Victims have the option of keeping their report of sexual assault in complete confidence, protecting their right to anonymity, when making a report to the Student Health Center, Student Counseling Center and Office of Sexual Assault Prevention.

College grievance action, criminal prosecution and civil suit are all options available to victims of sexual assault. To begin college grievance action a counselor, police officer or victim should contact the Office of the Vice President for Student Affairs. Sanctions for violation of the Student Conduct Code and/or the Social Contract may range up to and include suspension or expulsion from Evergreen.
